Our Immigration Lawyers are ready to help you

Extending your Spouse / Partner Visa

You can only apply to extend your leave to remain to stay with your spouse if you are already in the UK on a family visa. The extension as a spouse can be applied before your Spouse Visa is due to expire.

The requirement to extend your leave is similar to the Spouse Visa.  However, you will have to prove that you are in a subsisting relationship with your spouse and you have been cohabiting together as a spouse.

To prove the above the Applicant will have to provide a marriage certificate and various proof of address on the same address.

The extension for a Spouse Visa in the UK allows you to extend your stay to the point where you can apply for Indefinite Leave to Remain (ILR) after 5 years.

We would suggest you speak to our highly expert Immigration Solicitors to ensure you are on the right track and all of your documents are correct. We would suggest you contact our Immigration Lawyers at least 8 months before your visa expires if you are an employee of a company and if you are self-employed or a director of a company then contact us at least 12 months prior to your visa expiry date.

Requirements for Spouse Visa Renewal Under 5 Years Route

There are many requirements to be fulfilled for a spouse visa to be renewed successfully. The list below read the most important requirements for a Spouse Visa extension.

  • The applicant must be lawfully residing in the UK with leave to enter or remain as a spouse of a British Citizen or settled person.
  • The applicant should meet the suitability requirements.
  • English language requirement at level A2 of CEFR.
  • The adequate accommodation.
  • The applicant should provide evidence of a genuine and subsisting relationship with the UK spouse, along with evidence of cohabitation covering at least the last 2 years before the date of application.
  • The applicant should provide documentary evidence to meet the financial requirement. The financial requirements are exactly the same as the spouse visa entry clearance requirements.
Switching to a family visa

If you came to the UK on a different visa, you might be able to switch to a family visa to stay with your:

  • spouse or partner
  • child
  • parent

You can switch at any time before your current permission to stay in the UK expires.
