We at Intime Immigration Solicitors are professional to take care of every problem related to UK visa and settlement applications, like human rights, including private life applications.

Private Life Visa Application allows an individual in the UK all the rights to live and create a private life for many years while staying in this country. According to the family immigration scheme in the UK, the private life route is a category based on Article 8 of the ECHR1. Under Article 8, family and private life are considered as your relationships with your wife, children under 18, long-term partner, or even civil partner.

According to Article 8, the private life of an individual can also include neighbours, friends, study and even work life. Plus, your involvement with charity activities and the local community, including long-term medical treatment in the NHS comes under the human rights to lead a private life.

The overall process for private life visa application is challenging and overwhelming to understand. With our private immigration lawyers, you can have expert guidance and help throughout the procedure of applying for a private life visa. You can give us a call even for a no-obligation assessment!

Under Article 8, Human Rights say that an individual has the right to respect his or her home, private and family life and correspondence. According to this, a public authority cannot interfere in this right except when it comes to the national security, safety, prevention of crime, rights and others’ independence and economic well-being of the country.

With the assistance of family immigration solicitors, you can apply for a 10-year route to settlement on a private life visa. If your application is accepted, you will be eligible for the private life visa for the 10-year Route To Settlement. Thus, you will receive leave for 30 months that you need to renew until you live in the UK for ten years. After that, you can make an application for Indefinite Leave to Remain.

Also, if your partner and children do not have lawful immigration leave, it is possible to include your family in your application as well.

Whether you can apply for a private life visa in the UK or not, depends on several circumstances. Plus, how long you will be allowed to live here depends on your age from the day you arrived here and your situation. Here is what decided you are eligible for a private life visa:

  • When you are under 18 and have lived in the UK 7 consecutive years
  • At the age of 18 to 24, you have resided in the UK for more than half years of your age
  • You are an adult but living in the UK for less than 20 years while having problems with going back to your home country
  • Your parents are permitted to stay in the UK based on a private life visa or application for permission.

While applying for a private life visa, it’s necessary to follow and remember the points we have mentioned below:

  • You need to apply for all the private life visas within the UK
  • For private and family life in the UK, the Home Office allows consideration for family life rights before the right of an individual. Our family visa solicitors can guide you throughout the procedure while informing you regarding the rule implications to ensure it will affect your application or not.
  • You cannot apply for a private life visa while making an asylum or protection claim saying your application is or might be inadmissible by the Home Office.

Eligibility Requirements for Private Life Visa Application

To ensure a successful private life visa application, you need to bear these requirements in mind:

  • You must be in the UK while submitting your application to the Home Office
  • If you are applying for your children, they should live in the UK for at least 7 consecutive years
  • While arriving in the UK before 18, you have to spend at least half of your life living here continuously
  • If you are 20 years or more, you must live in the UK continuously. In fact, the period of continuity can break when you live just six months outside the UK even for once.

Further Information

On the grounds of suitability, the House Office can deny or reject the private life application of an individual. Here’s who are not eligible to apply:

  • Allowing the visa will not be good for public safety and security, like offending or imprisonment
  • The individual applying for the private visa has failed to appear in the interview, attend a medical examination, or provide genuine details, or medical reports.
  • Not explaining the essential facts for the application
  • Representing false documents and information

This length of the period can vary from one person to another depending on various circumstances including the age of the applicant. In most cases, you are permitted to stay around 30 months which you can extend by further 30 months with another application.

For adults aged between 18 and 25 years who spent half of their life in the UK are allowed to stay for 60 months or five years while for children, it’s a 7-year private life route.

Remember you fill out the extension form for the private life visa application and submit it before the existing visa expires.

There’s a 7-year private life route for children under 18 but they have to reside within the UK for at least seven continuous years. Under this visa, you (if not an adult) will get a private life visa for 5 years. And after that, you can make an application for Indefinite Leave to Remain (ILR).

For a young adult private life route called ‘early ILR concession’ for once, you must live in the UK for half of your life. If the visa applications are successful, the House Office will grant you 5 years. After this period, you can go for a permanent settlement (ILR) application.

The 20 years of private life in the UK route allows an adult (over 18 years) to stay in the UK after residing here for over 20 years. After a successful application, you will be granted 30 months and extended it even further.
