A child who has lived in the UK for a continuous seven years period should not be removed from the UK if no other countervailing factors were present, this policy was introduced on 9 July 2012. Seven years of residence by a child was formally incorporated into the rules as a sufficient period to justify continued residence by the child and parents.

A vast majority of the applicants who have been granted leave to remain under the 7 years child residence category would complete 10 years of continuous and lawful residence to be granted ILR under 10 years long residence category rather than 10 years under the 7 years child residence category.

Initial Application and the Basic Provision for 7 years child route:

  • the child is under 18;
  • the child is in the UK;
  • the child has lived continuously in the UK for at least 7 years (discounting any
    period of imprisonment); and
  • it would not be reasonable to expect the child to leave the UK.
  • Limited leave to remain may be granted for a period not exceeding 30 months if
    the application for leave to remain on these grounds is successful.

Indefinite Leave to Remain:
An application for Indefinite Leave to Remain (ILR) can be made after 10 years of continuous residence in the UK, under this visa category.

  • you have to leave to remain granted based on 7 years of child residence
  • you’ve completed 10 years with leave to remain granted under 7 years of child residence category
  • your application does not fall for refusal under the general grounds for refusal in part 9 of the Immigration Rules
